Arizona awards spousal maintenance under A.R.S. 25-319. The court first determines eligibility, then determines the amount and duration. Arizona is a no-fault state — marital misconduct does not affect alimony.
Eligibility criteria include: lacking sufficient property for reasonable needs, being unable to be self-sufficient, having contributed to the other's education or career, or having a long marriage with low earning capacity. Amount is based on the standard of living, duration of marriage, and each party's financial resources.
Rehabilitative alimony is most common. Duration is tied to the time needed for the recipient to gain education or employment. Courts rarely award permanent alimony.
